If thats the size of the patch thats not what the logo size needs to be with out touching it the logo is like almost 8x5 or something like that so it could be blown up enough and have black left around with no issues.

Thats an exact 13x9 image
It's not so much about image as it is file type. They want a vector file, which means it's almost infinitely scalable. A jpg or similar images are raster images and won't work with some printing systems. I used to be an apparel designer and some of those machines are quirky and not to mention many are running older software and can't handle the pixelation. So it's not just about blowing up the image.
I understand this but if he wants this just on a 13"x9" patch theres no reason to blow it up I have prolly made easily 100's of designs to size or larger and save as an EPS boom illustrator or coral draw will open it and they think they have a vector yes there will be issues if at some point they try to make it maybe like a 30"x26" but for something small like this there should be no issues.

Those look cool! Apparently the use of the Mexican flag, coat of arms or any national symbols is protected by law in Mexico and he would get in legal trouble. Here's the design I made for him that he's going to use.

I could always remove the flag aspect if that would cause issues. I thought about just using the colors but then it just looked like italy's flag. If he's already decided though then I don't need to worry about it. Its always fun playing around with photoshop.
i am a guy who has had to deal with several t shirt printers :)
here is a quick vector version of the current logo i saw. the gradients are set to a color half tone so that the printer can minimize the colors used and screens and therefore cost. anyway, if you are allowed gradients this can come out nicer but if you have a color limit this is the kind of thing you are looking at. if you let me know the specs i can send you the EPS or AI file of the version you need.
