Gray is sorta my favorite color, but not really...
You can tell he's pretty comfortable in rubber guard. Probably the most comfortable I have seen for mma. Kicks once they look to posture out would be quite interesting. There would be a lot of times where they are trying to posture out like that and you could full on soccer kick them with your free leg if all that needs to be is for their hands/knees to be off the mat.
Definitely legal! To be fair to the referee though it did happen pretty quickly, and in all honesty the ref was in the best position possible. If you pause the video at 39 seconds that's the angle the ref would have seen from where he was standing, and it does look like his knee is on the ground from that angle. Since it looked like he was setting up the omoplata it was a pretty smart place for the ref to be, seeing as he could watch the free arm to stop it quick if the top guy tapped.
Sick guard work though! Someone needs to do this in One FC where they have the Pride rule set, so there is no confusion!
As long as it's not to the back of the head it should be legal. Powerful weapon for sure.
I wonder if the ref had let it go on, what would've happened. Would his opponent get KO'd by those kicks, or fall to his knees, in wich case he could no longer legally kick his head, in most organisations.

Who said rubber guard is not used effectively in MMA!!!!???? Mckinnes killed it
