The 21 foot rule should cover him even if the other guy didn't have a firearm.
An assailant with an edged or blunt weapon can cover 21 feet and deliver a fatal blow by the time you draw and shoot. As long as the assailant was within that limit, with a weapon, blunt or edged, Gerald is in the clear.
Another point to consider in his defense is that he's a friggin black belt man. He can whoop ass with his bare hands. If he pulled a gun, it's because there was damn good reason. That's how I see it.
