It is 100% legal. Here is a quote from my reseller...
"The number one question I have been getting about the StreamSmart TV Box is about the legality of it. How is this legal? Well here it is.....
In an article on Business Insider, Jim Gibson, director of the Intellectual Property Institute at the University of Richmond law school, told Business Insider that streaming online content breaks the law in two cases.
“When the user downloads even part of a file — called “pseudo-streaming” — it counts as a copy of copyrighted material, which is illegal. And when the user streams content as a “public performance” — namely, when it’s shown to a substantial number of people outside the normal family circle and its close acquaintances — it also constitutes a copyright violation.
Outside of these cases, accessing unlicensed streamed content is generally legal.”
StreamSmart does not fall under either of these cases. StreamSmart will stay legal as long as the Internet stays legal.
STREAMSMART does not host, archive, store, or distribute media of any kind and acts only as an index of media which is hosted by third parties on the Internet. StreamSmart in no way condones Pirating and any downloading of media to the device is prohibited. The media is streamed to your TV but never stored, retained, or downloaded."
